AN ORDINANCE TO RE-CODIFY SECTION 52-24 – FEES, IN CHAPTER 52, ARTICLE II TO INCLUDE ESTABLISHED FEES FOR PLAT AND PLAN REVIEW FOR DIVISIONS AND SUBDIVISIONS IN THE CODE OF WASHINGTON COUNTY, VIRGINIA
WHEREAS, the Code of Virginia § 15.2-2241.9 provides a locality by ordinance, may impose reasonable fees and charges for the examination and approval of every plat and plan submitted for review;
WHEREAS, any person submitting plats and plans for review shall pay a fee in accordance with a fee schedule adopted by the Board of Supervisors, upon recommendation of the Zoning Official;
NOW, THEREFORE, be it resolved the Board of Supervisors of Washington County, Virginia, after notice and public hearing, as required by law, hereby adopts this Ordinance, which shall be incorporated into the Washington County Code (2002), to re-codify Section 52-24 in Chapter. 52, Article II, to impose reasonable fees for the examination and approval of every plat and plan submitted for review by the Zoning Official.
- That Chapter 52, Article II, Section 52-24 of the Code of Washington County, Virginia (2002), be re-codified, as set forth below.
- That should any section or provision of this Ordinance be decided to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity or constitutionality of any other section or provision of this Ordinance or the Washington County Code (2022).
- That this Ordinance shall become effective immediately upon its enactment.

Sec. 52-24: Fees
The purpose of this Division is to provide for the established fees for the examination and approval of plats and plans for divisions and subdivision of property. State Law Reference – Similar provisions, Code of Virginia §15.2-107
- For review of Final Plats for Major Subdivisions as defined by County Code Chapter 52 shall require a fee in the amount of $100.00 per plat page plus $5.00 for each lot and portion thereof shown;
- For review of Final Plats for all other divisions and subdivisions as defined by County Code Chapter 52; $5.00 for each lot and portion thereof shown;
- Appeals shall be conducted pursuant to County Code Chapter 66 (County Zoning Ordinance).
